The proliferation of smartphone and mobile computing technology has resulted in society’s dependence on the creation and exchange of electronically stored information. People store a substantial amount of private information on their mobile devices. Plastic credit cards are being replaced by their digital counterparts using “near field communication” technology at the cash register. Motor vehicles contain their own internal computers with “infotainment” data. Security systems connect with users across the cloud. Daily life occurs on the “ground,” but many routine transactions and interactions occur in the “cloud.” As a result, the definition of the “white collar” criminal case has evolved making it more routine at the state court level. The procedural and evidentiary issues these cases present can be streamlined and organized once identified.
