White Collar Criminal Cases at The State Court Level

April 25, 2023 @ 4:00 pm - 6:00 pm

The proliferation of smartphone and mobile computing technology has resulted in society’s dependence on the creation and exchange of electronically stored information.  People store a substantial amount of private information on their mobile devices.  Plastic credit cards are being replaced by their digital counterparts using “near field communication” technology at the cash register. Motor vehicles contain their own internal computers with “infotainment” data.  Security systems connect with users across the cloud. Daily life occurs on the “ground,” but many routine transactions and interactions occur in the “cloud.”  As a result, the definition of the “white collar” criminal case has evolved making it more routine at the state court level.  The procedural and evidentiary issues these cases present can be streamlined and organized once identified.
The following are some of the topics this program will cover accompanied by a “View from the Bench”:

  • Identifying automatic discovery under Mass. R. Crim. P. 14
  • Drafting and litigating the pretrial production of third-party records under Mass. R. Crim. P. 17
  • Document management and review tools
  • Cell Site Location Information (“CSLI”), social media evidence, motor vehicle data, and the Internet of Things (“IoT”)
  • Expert witnesses and forensics
  • Trial preparation and presentation
