THIS PROGRAM QUALIFIES FOR 2 CLE ON THE MENTAL HEALTH AND MENTAL HEALTH APPEALS PANELS
This will be a two-hour presentation and discussion with Attys. Anna Lembo, Esq., Worcester County Regional Coordinator and Toni Hall, Esq., Suffolk County Regional Coordinator.
The following topics will be covered:
- The P.R. decision and the impact on permissible expert testimony.
- The medical records exception to the rule against hearsay.
- The mechanics of admitting medical records into evidence.
- Relevant case law and statutes including: Bouchie v. Murray, 376 Mass. 524 (1978), Doyle v Dong, 412 Mass. 682 (1992)
- “Pellegrini Method” and other court practices/methods regarding the admission of medical records.
- Accepted practices in courts regarding the admission of medical records.
- Proper use of motions in limine and objections to preserve the record for appeal.
- Open the Door on cross-examination – tactics to avoid.
The final hour will include a participant discussion soliciting examples from current practices involving local courts and cases.
