Discussion of Role of CPCS Counsel in Probate Court Rogers Reviews

Bristol County Regional Coordinator Michael O’Brien will review the role of assigned counsel at periodic reviews of “Rogers” medication treatment orders. The program will begin with a brief history of the current law that all substituted judgment orders must be reviewed at least annually. The applicable provisions of the Massachusetts Uniform Probate Code will be reviewed. Topics will include the steps assigned counsel should take regarding lapsed orders, changed circumstances that may affect the client’s capacity, insufficient completion of required documents, and the potential need for an independent medical examiner. Time permitting, attendees will be asked to share their practical tips in dealing with these issues.
