The A to Z of Com. v. A. Z.: Unlawful Detention/Hospitalization in the Context of Competency Evaluations

 After you attend the training, you will be able to:

  • Identify when and how competency evaluations and bail are being used to unlawfully detain and hospitalize clients, and the impact of these unlawful detentions/hospitalizations;
  • Explore the legal landscape—including recent and ongoing litigation—governing bail determinations and inpatient competency evaluations;
  • Effectively challenge detention without bail and inpatient competency evaluations in the trial court with available resources and strategies; and
  • Describe possible avenues of additional appellate relief.
