School Discipline Law Including Manifestation Determination Reviews
Attendees will learn about the laws and regulations regarding
school discipline in Massachusetts. Since so many clients are
excluded as a result of behavior that may lead to charges within
the school or for offenses that occur out of school, this is an
important part of effective client advocacy. Attendees will
learn about the different types of disciplinary actions that can
be taken, the three types of school exclusion by law – Chapters
37H, 37H ½, and 37 H ¾ They will learn about Chapter 222
which increased the rights of students who are excluded and the
special protections that students with disabilities (on an IEP or
504 plan) have when facing long-term suspension or expulsion.
