Let’s talk about how powerful juries can be, even when presented with strong evidence by the Commonwealth.
In 1851 a group of Bostonians helped free Shadrach Minkins, who was being jailed in federal custody for violating the Fugitive Slave Act. Though seven were charged, the government was unable to achieve even one conviction at trial. Juries still take the power to nullify today. As we know, the defense is not allowed to argue for nullification, but this training will help us all find out about some situations where juries choose to nullify and the information jurors may look for in choosing to nullify.
