As practitioners endeavoring to challenge state oppression\, it is vital to address racial bias and treatment as they manifest in each of our cases. Using statistical data and research that underscores existing racism can be powerfully persuasive when your client needs to address issues of race in the court room. The traditional court system has historically penalized our clients for what is now known as the natural course of sobriety which includes relapse. We are excited about the new Family Treatment Court in Hampden County (“FTC”). The FTC offers our clients a path to sobriety that has the potential to speed the process of reunification in a less formal and more supportive environment while helping them pursue recovery. As anticipated\, there are many questions about the FTC. Please come to a training on March 6 from 1-3:30 p.m. on Zoom to learn about how Family Treatment Court works. During the training you will have an opportunity to hear from someone with lived experience of the Family Treatment Court in Franklin County as well as court staff and CAFL. We will give a brief overview of the challenges our parent clients with substance use disorder face\, discuss why FTC can be beneficial to our clients\, and how it works. We will also cover advising clients about it\, the role of counsel in FTC cases\, and dispelling misconceptions about FTC. There will be plenty of time for questions at the end. DESCRIPTION:[vc_row][vc_column][vc_column_text] \nSeeking Counsel for Child Welfare/State Intervention Appeals\nThe Committee for Public Counsel Services (CPCS) is seeking private attorneys to join the Children and Family Law (CAFL) Division appellate panel.  CAFL appeals are appeals of final judgments in care and protection\, termination of parental rights\, guardianship of a minor\, contested adoption\, and other child welfare/state intervention proceedings.  Most cases concern intervention by the Massachusetts Department of Children and Families in family life.  The work of the CAFL appellate panel attorneys includes interviewing and visiting clients\, conducting legal research\, writing motions and briefs\, and arguing cases before the Massachusetts Appeals Court and Supreme Judicial Court.  All CAFL appeals get oral argument.  Private panel attorneys handle the vast majority of CAFL appeals; other CAFL appeals are handled by the CAFL Appellate (staff) Unit.  This posting is not for a staff position; it is for private attorneys to obtain certification to receive\, and be compensated for\, CAFL appellate appointments.  Compensation is $85/hour.  During the first year after completing the mandatory training\, newly certified attorneys are expected to take at least one appellant and one appellee assignment.  Panel members should expect to spend about 100-250 hours on each CAFL appeal. Harkins\, Esq. – Senior Reference Attorney\, Social Law Library \nOnline Only \nLegislative history is a critically important advocacy tool in Federal Court when statutory language is ambiguous and begs for clarification. Federal judges invite and apply the use of legislative history to avoid incongruous results\, illuminate drafting errors\, determine specialized meanings\, or choose reasonable interpretations of politically controversial statutes.   \nIn these and other instances\, Congress’s intent must be inferred from the statute’s legislative history\, which successful advocates must stitch together from a variety of sources including: \n\nThe text of the bill and proposed amendments that were accepted or rejected\nTranscripts of hearings conducted by Congressional committees responsible for the bill\nCommittee reports written about the bill\nCommittee prints\nCompiled legislative history\nTranscripts of House and Senate floor debates related to the bill\n\nAlex Philipson\, who has taught classes in appellate writing at New England Law Boston and Northeastern University Law School\, and Senior Reference Attorney Brian Harkins and Law Librarian Karen Breda will show the “how” and “where” to find and interpret these and other sources of legislative history. \nThis program teaches advocates the research skills necessary to reconstruct a statute’s legislative history for use in pleadings\, briefs and oral arguments. \n$40 \nCPCS approved for 2.0 hours of credit from CAFL. To receive credits attendees must be logged on during the program for a minimum of 80% of the conference time.
