SUMMARY:NCLER Promoting Autonomy for Older Adults and Adults with Disabilities through Decisional and Other Supports
DESCRIPTION:[vc_row][vc_column][vc_column_text]Everyone needs a little support now and then. For some older adults and adults with disabilities\, getting the support they need can be critical to maintaining their independence and self-determination. The training will explore strategies for identifying and implementing decisional and other supports for adults who might need assistance in particular areas\, and will discuss how advocates who work with adults can\, through the thoughtful implementation of well-crafted supports\, maximize their client’s autonomy while minimizing the intrusion on decision-making authority. This training will look at the broad range of support mechanisms and strategies available—formal and informal\, legal and nonlegal— including: \n\nSupported decision-making;\nInformal supports\, like family\, friends\, neighbors\, and community and religious organizations;\nSocial supports\, including day programs\, housekeeping services\, congregate or delivered meals\, and transportation services;\nFinancial supports\, such as automated banking\, restricted debit/credit cards\, joint bank accounts\, representative payees\, powers of attorney\, and trusts; and\nHealthcare supports\, like virtual electronic monitoring\, decision-making proxies\, and powers of attorney.\n\nPresenters will also provide clarifying examples to demonstrate how you can effectively counsel clients to guide them through selecting the appropriate supports and their trusted supporters. \nPresenters: \n\nAllison Cohen Hall\, PhD\, Institute for Community Inclusion\, University of Massachusetts Boston\nJim Berchtold\, Esq.\, Justice in Aging\n\nCapacity for this session is limited to 3\,000 participants\, and all participants will have the option of accessing audio through the computer or by phone. When representing a person with a guardian or someone who is allegedly in need of a guardian\, an attorney may need to take extra steps to ensure their client has the right to counsel of their choice and to be a strong advocate on behalf of the client. This includes ensuring the client is present in the proceedings and treated with dignity and that the client’s due process rights are upheld. By using procedural and evidentiary tools— including alternatives to guardianship—advocates can increase clients’ independence and autonomy and restore their civil rights. This training will build on the concepts discussed in the second training in this series\, Representing Clients with a Range of Decisional Capabilities. \nPresenters will share: \n· Considerations for representing clients with a range of decisional capabilities; \n· Strategies for advocating for clients’ rights; \n· Standards and burdens for opposing\, modifying\, or terminating guardianship; and \n· Building systems and partnerships to engage with clients in need of these services. \nPresenters: \n· Introduction: Francis Nugent\, Legal Services Corporation and Hilary Dalin\, Administration for Community Living \n· Jim Berchtold\, Justice in Aging \n· Gabrielle Marshall\, Texas Rio Grande Legal Aid \nCapacity for this session is limited to 3\,000 participants\, and all participants will have the option of accessing audio through the computer or by phone.
