DESCRIPTION:[vc_row][vc_column][vc_column_text]Many of our clients struggle with substance use disorders. The traditional court system has historically penalized our clients for what is now known as the natural course of sobriety which includes relapse. We are excited about the new Family Treatment Court in Hampden County (“FTC”). The FTC offers our clients a path to sobriety that has the potential to speed the process of reunification in a less formal and more supportive environment while helping them pursue recovery. As anticipated\, there are many questions about the FTC. Please come to a training on March 6 from 1-3:30 p.m. on Zoom to learn about how Family Treatment Court works. During the training you will have an opportunity to hear from someone with lived experience of the Family Treatment Court in Franklin County as well as court staff and CAFL. We will give a brief overview of the challenges our parent clients with substance use disorder face\, discuss why FTC can be beneficial to our clients\, and how it works. We will also cover advising clients about it\, the role of counsel in FTC cases\, and dispelling misconceptions about FTC. There will be plenty of time for questions at the end. DESCRIPTION:[vc_row][vc_column][vc_column_text] \nSeeking Counsel for Child Welfare/State Intervention Appeals\nThe Committee for Public Counsel Services (CPCS) is seeking private attorneys to join the Children and Family Law (CAFL) Division appellate panel.  CAFL appeals are appeals of final judgments in care and protection\, termination of parental rights\, guardianship of a minor\, contested adoption\, and other child welfare/state intervention proceedings.  Most cases concern intervention by the Massachusetts Department of Children and Families in family life.  The work of the CAFL appellate panel attorneys includes interviewing and visiting clients\, conducting legal research\, writing motions and briefs\, and arguing cases before the Massachusetts Appeals Court and Supreme Judicial Court.  All CAFL appeals get oral argument.  Private panel attorneys handle the vast majority of CAFL appeals; other CAFL appeals are handled by the CAFL Appellate (staff) Unit.  This posting is not for a staff position; it is for private attorneys to obtain certification to receive\, and be compensated for\, CAFL appellate appointments.  Compensation is $85/hour.  During the first year after completing the mandatory training\, newly certified attorneys are expected to take at least one appellant and one appellee assignment.  Panel members should expect to spend about 100-250 hours on each CAFL appeal. DESCRIPTION:[vc_row][vc_column][vc_column_text]Each year we host a two part webinar on medical treatment decisions for children in DCF custody (aka “Rogers” training).  The first session reviews the legal process for hearings in Juvenile Court seeking judicial authorization to administer extraordinary medical treatment to child clients in DCF custody.  In the second session\, a child psychiatrist will review mental health issues and medication for children.  All CAFL attorneys are required to complete this program. \nThe next Rogers Training will take place via Zoom on November 1&7\, 2023 from 2:00-4:00 pm. DESCRIPTION:[vc_row][vc_column][vc_column_text]CPCS is now accepting applications for its Fall 2023 CAFL Trial Panel Certification Training to represent children and parents in care and protection/termination of parental rights and child requiring assistance (CRA) cases. The training includes full day in-person sessions\, half-day live zoom sessions\, and substantial self-directed learning. The training concludes with a full day in-person mock temporary custody hearing.  Attorneys accepted into this training will receive a “Certification Payment” of $5032 upon the following: 1) successful completion of the CAFL Trial Panel Certification Training; and 2) within twelve months of completing the training the attorney (a) receives appointments on 12 care and protection cases\, and (b) submits 600 hours of billing on care and protection cases. \nCPCS is committed to ensuring that the panel of attorneys accepting CAFL assignments is sensitive to the diversity of the client population it serves.  We will give preference on a rolling basis to attorneys who submit completed applications by Wednesday\, July 26\, 2023\, although we will continue to accept applications after that time.  We encourage interested attorneys to apply early and not wait until the deadline.
