SUMMARY:Writing to Persuade - Day Two
DESCRIPTION:“Writing to Persuade” – Day Two \n Presenter: Prof. Timothy Terrell \nEmory Univ. School of Law \nMay 9 & 13\, 2022 \n1pm to 4pm both days – On Zoom \n Persuasive writing is not a product of gimmicks or isolated tips.  It is instead based on a deeper understanding of the elements of rhetoric and their relation to the fundamental principles of excellent writing.  This perspective emphasizes the methods of communicating with a skeptical\, risk-averse reader:  strong introductions\, compelling presentations of law and facts\, and the flow of one’s prose.  This program therefore begins at the “macro” level of a brief’s organization and moves later to the “micro” levels of paragraph and sentence structure.  Examples are developed in detail throughout. \nThis program will be valuable for attorneys who practice in the trial courts and the appellate courts\, alike. While Professor Terrell will use terms like “brief” and likely examples from appellate filings\, the content of the program will be applicable and useful to any attorney who wishes to sharpen their persuasive writing skills. \nTimothy P. Terrell is a Professor of Law at Emory Law School. He has three distinct areas of teaching and scholarly reputation: legal writing\, legal ethics\, and legal theory. He has published extensively on all these topics\, and frequently conducts continuing legal education programs on them as well. Concerning legal writing in particular\, he is\, among law faculty nationwide\, the leading presenter of programs for practicing lawyers and judges\, not just in the United States\, but around the world. He is the co-author of Thinking Like a Writer: A Lawyer’s Guide to Effective Writing and Editing\, a practical guide to help lawyers strengthen their writing skills by “thinking like a writer” as effectively as they already think like a lawyer. \nThis program has been approved for 6 CLEs (3 for each day of attendance) on the following CPCS Panels: \nAdult Criminal\, Adult Criminal Appeals\, YAD\, YAD Appeals\, MHLD\, CAFL \n The program has been approved for 4 CLE (2 for each day of attendance) on the SORB/SDP Panel \nPlease note this is one presentation spanning over two days\, ideally participants will attend both days. \nRegister Here: \nhttps://us02web.zoom.us/meeting/register/tZAqdOCppzwqGNEo5iqlrlemtE0sJo28Y0Y-

There are a variety of different tools and techniques that are being used to capture the information from these devices. Understanding what the standards are that should be followed will allow you to have a good expectation for the data that is being produced. Did they get all possible information with their image type? What should you be seeing in the data from the device? What about deleted information? This session will review all of these topics to give you a solid understanding of what should be happening with a smartphone acquisition. \nSmartphone Apps Parsed and Unparsed \nApps are where most of the time is spent on a smart device. However\, the storage of the data associated with these Apps can change based on a few factors. From what is on the device to what is now being stored in the cloud you can learn what you should be looking for when it comes to the analysis of App data from smart devices. What is the difference between parsed and unparsed data and how can you tell if you received all that was possible? All of these questions and more will be answered in regards to the most popular Apps for both Apple and Android devices. \nAmber Schroader Bio: Over the past three decades\, Ms. Schroader has been a driving force for innovation in digital forensics. Ms. Schroader has developed numerous software programs\, courses\, and guides in the areas of recovering data from smartphones\, computer hard drives\, cloud\, email\, and gaming systems. Coaching and training faculty will consist of criminal defense lawyers experienced in Superior Court Practice.   The cost for this training program is $100.\nThe stakes are much higher for clients who have been indicted\, and there are important differences in Superior Court practice even for a defense attorney with substantial experience in District Court.  The course will address procedural and substantive topics that every criminal defense lawyer practicing in Superior Court must know.  Participants will also work on advanced trial advocacy skills in the context of cases commonly encountered in a Superior Court Practice. \nAmong other things\, we plan to cover the following topics during the course: \n\nStrategic use of forensic experts in pretrial case preparation and at trial\, including tips on how to successfully challenge the prosecution’s expert qualifications and opinion;\nMotion practice including the legal grounds and evidentiary basis for discovery of protected information under the Lampron/Dwyer seven step protocol to produce\, inspect and use privileged records in court;\nGrand jury proceedings\, indictments\, immunity issues;\nEvidentiary and forensic issues involved in trying sexual assault allegations such as first complaint evidence\, Sexual Assault Nurse Examiner (SANE) examinations\, and DNA evidence;\nIssues in gang allegations;\nTips for creating and maintaining good client relations in the high stress setting of a Superior Court case;\nProcedural aspects of Superior Court practice\, including the procedural life of a case;\nOpening Statement\, Cross Examination and Closing Argument in complex cases.\nPlease note: there is homework assigned each night as part of this course\n\nWe have re-designed the live version of Superior Court Training into an online program utilizing our learning management system\, Talent LMS. The first week of the program will allow you to prepare for the course by working asynchronously (watching recorded lectures on your own time).  Once the program begins\, you will continue to work asynchronously (watching recorded videos on your own) and you will join us three afternoons  each week (Tuesdays\, Wednesdays and Thursdays from 1pm to 4:00 pm) for live lectures and small group sessions (with on your feet skills exercises).  You will also be assigned homework for each live session. We are hoping the last day of the program will happen live (in person!!) but this will depend on various factors. \nZoom session dates are as follows: \nFriday\, May 6\, 2022\, 3pm to 4:30 pm Welcome and Introduction to course on Zoom \nPre Work on Talent LMS – on your own May 9-13\, 2022 (no zoom sessions this week) \nWeek One Zoom Sessions: May 17\, 18\, 19 (Tues\, Wed\, Thurs) 1pm to 4pm \nWeek Two Zoom Sessions: May 24\, 25\, 26 (Tues\, Wed\, Thurs) 1pm to 4pm \nWeek Three Zoom Sessions: May 31\, June 1\, 2\, (Tues\, Wed\, Thurs) 1pm to 4pm \nWeek Four Zoom Sessions: June 7\, 8\, 9 (Tues\, Wed\, Thurs) 1pm to 4pm \nSpace is limited and the course is likely to fill up fast.  Acceptance into the program is based on a number of factors\, including an effort to obtain geographic and other diversity. \nTo apply for this training opportunity\, please send a statement of interest by email \nto kmunichiello@localhost/cpcs and cc. ksmolar@localhost/cpcs \nYour application must be received by April 1\, 2022.   Please include the following information; \n\nHow long you have practiced criminal defense;\nWhether you are on the Superior\, Youthful Offender\, Juvenile or District Court panel(s) and how long you have been on each;\nDescribe the number and types of jury trials you have undertaken\, including the nature of the charges and whether the trials were in Superior\, District Court or Juvenile Court;\nWhether you have cross examined or presented expert witnesses;\nList the bar advocate programs to which you belong and whether you are a member of any other CPCS certification list.
