Massachusetts Upstream is based in public health and collective impact approaches\, creating a community-based map of the local child welfare landscape to (1) identify resources and gaps in practices\, protocols\, and programs\, (2) collectively agree on priorities for change\, and (3) develop an action plan to improve system and service-level responses.

SUMMARY:Motion in Limine practice in the Berkshires
DESCRIPTION:In this one-hour training\, Emily Herder and Dorothy Storrow will discuss the ins and outs of Motion in Limine practice in the Berkshires.  Participants will receive Attorney Herder’s extensively researched model motion and memo of law.  These pleadings can be used as a starting point for your motions in limine.  They also provide an extensive review of the evidentiary law governing admission of documentary evidence in CAFL proceedings.  Learn how Attorney Herder has used this model to streamline drafting motions in limine.  Hone your arguments to successfully argue for specific and timely rulings by learning why summary rulings and delayed rulings each violate your client’s due process rights.  Discuss some of the critical case law and find out how the judges have been ruling on various objections.  Join your peers in a discussion of winning and losing strategies.  It is a lot to cover in an hour – but we will do our best to make it enjoyable (at least far more enjoyable than drafting motions in limine without this great tool).  And we will do our best to answer your questions.\n  \nPLEASE REGISTER via email to: DOROTHY M. For many Black and brown youth\, the daily\, discriminatory\, and unnecessary encounters with police is overwhelming and traumatic. \nIn this session\, participants will learn how to incorporate “policing as trauma” arguments into their advocacy at every stage of a delinquency proceeding\, including client interviews\, detention and probable cause hearings\, disposition hearings\, Fourth and Fifth Amendment motions to suppress\, motions for a trauma-informed mens rea\, motions to dismiss in the interest of justice\, self-defense arguments\, probation violations\, and introduction of expert testimony. \nParticipants will: \n\nLearn from the research and studies on the trauma of policing and racism;\nIdentify the psychological and emotional trauma caused by policing tactics such as stop and frisk\, interrogation\, detention\, etc.;\nConsider the impact of this trauma on the attorney-client relationship and client interviews; and\nDevelop arguments that raise policing as trauma in a delinquency case.\n\n  \nCLE Credits offered for: \n\nCAFL\nYAD/YAD Appeals\nCriminal Trial\nMHLD
