DESCRIPTION:The Norfolk County Juvenile Court is pleased to host an educational program concerning substance disorders and treatment on THURSDAY\, JANUARY 12\, 2023\, from 2PM to 4PM at our Dedham session located at 55 Allied Drive. The program will be offered in-person and online via Zoom.\nThe presenters are Dr. Michael Hamrock and Ryan Morgan. Dr. Hamrock is a primary care and addiction medicine physician at St. Elizabeth’s Medical Center and Carney Hospital. Mr. Morgan is the principal/director of Independence Academy\, a recovery high school. \nTrial Court personnel\, probation\, court clinicians\, Department of Children and Families\, CPCS and CAFL staff attorneys and social workers\, private bar\, assistant district attorneys\, and other professionals and agency representatives are invited and encouraged to attend. This program is not limited to those who work in Norfolk County; CPCS staff and private bar attorneys from other counties are welcome. \n  \nTopics to be covered: \n  \nUnderstanding the Brain Disease of Addiction \nThe presentation by Dr. Hamrock will help raise the awareness of the unique risk factors for opiate use disorders and their impact on hijacking specific brain circuit pathways that leads to addiction. Participants will gain a better understanding of the therapeutic modalities used in Medication Assisted Treatment programs to optimally manage those afflicted with addictions. A review of effective prevention and intervention strategies that help target the key risk factors for opiate use disorders will be highlighted. A discussion on novel therapeutic approaches that offer real hope and a second chance to those afflicted with substance use disorders and their associated harmful and illicit behaviors will also be undertaken. \n  \nRedefining Recovery: A growth and development model to fight addiction \nThe presentation by Mr. Morgan will address why some adolescents struggle with substances more than others? What does “typical” adolescent substance use look like? Why have adolescent residential treatment facilities in MA closed? Independence Academy has created a growth and development model grounded in the concept of Adolescent Recovery Capital. We believe that there are 13 domains that are critical to the healthy growth and development of adolescents. We believe that when an adolescent forms an awareness of each of the domains and how the domains are represented in their own life\, that we can then build clarity around their individual needs and engage them in a personalized approach to the cultivation and development of capital through meaningful action. This presentation will highlight the key aspects of our model and show how the 13 domains are inextricably connected. Participants will gain a better understanding of the developmentally appropriate ways to address adolescent substance use so that it is less likely to become a lifelong addiction or dependence issue. \n  \nThere will be a “Q and A” session with the speakers. DECISION AND THE MEDICAL RECORDS EXCEPTION TO THE HEARSAY RULE \nHOUR ONE \nAttorneys Joan LeGraw and Mike O’Brien will give a presentation on the P.R. decision\, its history\, and the impact on permissible expert testimony. The second part of the presentation will review the medical records exception to the rule against hearsay .  We will review the Bouchie decision and its progeny and discuss how the caselaw provides a roadmap for counsel to analyze the admissibility of medical records.  Following the presentation there will be an opportunity for audience questions or comments. SUMMARY:Jake J. Go Away: Challenging Release Conditions ordered under c. 276\, § 87
DESCRIPTION:Children charged with crimes in Massachusetts are often subjected to onerous pretrial conditions pursuant to G.L. c. 276\, § 87\, which permits judges to impose any pretrial condition of release if the youth consents to its imposition. These conditions are monitored by probation officers\, who receive school reports\, demand urine tests for drug screens\, talk to parents and DCF workers about behaviors at home\, and bring forth violation proceedings subjecting youth to DYS detention for up to 90 days—all before a youth has been adjudicated delinquent or pleaded to sufficient facts. And\, often\, a youth’s “consent” to such conditions is coerced by the threat of detention.\nThis training will explore how to strategically challenge conditions imposed under § 87 in Juvenile Courts. SUMMARY:Litigating Complex Rule 30 Motions: Case Studies in What Worked
DESCRIPTION:This webinar series offers practical\, case-based strategies for evaluating and building a record in support of Rule 30 motions that relate to three common causes of wrongful convictions: Eyewitness Identifications\, False/ Coerced Confessions\, and Brady Violations. Using concrete examples from successful cases\, each two hour session will walk participants through the steps needed to identify\, investigate and present claims involving one of these subject areas.\nFeb. 1\, 2023: Eyewitness Identifications. In this session\, Innocence Program Staff Counsel Jill Tessier and eyewitness ID expert Dr. Nancy Franklin will discuss their approaches to identifying sources of eyewitness error and working with experts to effectively present them in court. Attorney Merritt Schnipper will then describe the role that eyewitness error claims played in overturning the 1976 murder conviction of Raymond Gaines. \n Feb. 8\, 2023: Brady violations. In this session\, Innocence Program Director Lisa Kavanaugh and Attorneys Jeff Harris and Chauncey Wood will explore the unique challenges of uncovering evidence of Brady violations. Using concrete examples from their own cases\, they will describe the specific strategies they employed to develop\, document and litigate Brady claims. Participants will also hear from MA exoneree Robert Foxworth\, who will talk about the importance of partnering with your client to develop and present these claims. \nFeb. 15\, 2023: False and unreliable confessions. In this session\, Innocence Program Staff Counsel Libby Hugetz will provide a brief introduction about how to identify the various forms of false and coerced confessions.
