SUMMARY:Litigating Complex Rule 30 Motions: Case Studies in What Worked
DESCRIPTION:This webinar series offers practical\, case-based strategies for evaluating and building a record in support of Rule 30 motions that relate to three common causes of wrongful convictions: Eyewitness Identifications\, False/ Coerced Confessions\, and Brady Violations. Using concrete examples from successful cases\, each two hour session will walk participants through the steps needed to identify\, investigate and present claims involving one of these subject areas.\nFeb. 1\, 2023: Eyewitness Identifications. In this session\, Innocence Program Staff Counsel Jill Tessier and eyewitness ID expert Dr. Nancy Franklin will discuss their approaches to identifying sources of eyewitness error and working with experts to effectively present them in court. Attorney Merritt Schnipper will then describe the role that eyewitness error claims played in overturning the 1976 murder conviction of Raymond Gaines. \n Feb. 8\, 2023: Brady violations. In this session\, Innocence Program Director Lisa Kavanaugh and Attorneys Jeff Harris and Chauncey Wood will explore the unique challenges of uncovering evidence of Brady violations. Using concrete examples from their own cases\, they will describe the specific strategies they employed to develop\, document and litigate Brady claims. Participants will also hear from MA exoneree Robert Foxworth\, who will talk about the importance of partnering with your client to develop and present these claims. \nFeb. 15\, 2023: False and unreliable confessions. In this session\, Innocence Program Staff Counsel Libby Hugetz will provide a brief introduction about how to identify the various forms of false and coerced confessions. DESCRIPTION:Mental Health Litigation Training Unit Presents (again):\nRefresh and Hone Your Cross Exam Skills:\nUsing trial transcripts to demonstrate effective ways to conduct a powerful cross \n In all your cases\, you need to conduct strategic and effective cross examination in order to successfully argue why the court should deny the petitioner’s case. What better way to improve your cross skills than to view transcripts of actual cross examinations for what to emulate and what to improve? \nCome join us on February 10th from 2-4 p.m. \n2 CLE Credits (MH trial and appellate panels) \n We will discuss and review fundamental cross examination technique\, theory and strategy\, and demonstrate a problematic cross followed by an improved examination. We will then break out into small groups facilitated by MHLD staff to review transcripts together to identify which cross exams were effective and practice conducting cross exams to make others more effective. \n After the training\, you will be able to: \n\nExplain when & why to use a constructive or destructive cross technique and your theory of the case & witness;\nIdentify the Three Rules of Cross;\nRecognize good and bad examples of effective cross examination;\nDemonstrate how to correct the ineffective sample cross examinations with proper cross technique\n\nRegistration is limited to 40 participants because there is brainstorming and “on your feet” skills practice in small groups. DESCRIPTION:Goetzendanner: the Most Important Case You’ve Never Heard Of\nParole and Sentencing for Defense Attorneys\, Part 1 \nMarch 15\, 2023 1-3pm \nVirtual Training on Zoom \n  \nPlease save the date for the first in a new training series on Parole and Sentencing\, brought to you by the Criminal Defense Trainers and the Parole Advocacy Unit. \n  \nClients charged with new offenses or probation violations while also on parole supervision face a substantial risk that the remainder of their parole sentence will run consecutively to their new sentence – even if the judge and probation clearly promises that it won’t. This problem can cost someone months and even years of additional incarceration\, and it is very difficult to undo. Join us to learn about the implications of Goetzendanner v. Superintendent. By the conclusion of the training\, you will know how to spot and avoid the problem\, educate the judge\, and set your client up for a truly concurrent sentence (while also learning how to pronounce this tremendously important case). \n  \nPresenters: Sentencing expert Lee Gartenberg trains judges on this and many other issues.
