SUMMARY:New Developments in DNA and Rape Kit Analysis
DESCRIPTION:[vc_row][vc_column][vc_column_text]This program is hosted by Central Middlesex County Bar Association. Any questions or issues regarding this program should be directed there. (Ellie Hertzberg (erh8@cornell.edu)\, Robyn Larsen (mdalawrobyn@yahoo.com )\, or Veronica Zolina (vzolina@verizon.net)). This event is being listed for informational purposes only. CPCS staff cannot assist with\, or solve\, registration issues. \nThe Central Middlesex County Bar Association invites you to attend our next CLE entitled: \n  \nNEW DEVELOPMENTS IN DNA AND RAPE KIT ANALYSIS \n(The ADAs have had this training.  Shouldn’t you?) \n  \nHistorically\, DNA comparisons were made based on the presence or absence of alleles only and the statistic was reported as an expected frequency of occurrence of that DNA profile.  But the forensic community is evolving to be able to consider all of the information present in a mixture\, not just the alleles that are present or absent. \nDue in part to the efforts made to eliminate the sexual assault kit backlog\, the MA State Police Criminology Unit is no longer routinely screening all sexual assault kit samples for sperm cells.  Instead\, a process known as Y-screening has been implemented which allows for the detection of male DNA in a sample prior to the DNA sample selection. \nOur speaker\, Jessica Hart\, will bring you up to date with the Crime Lab’s current DNA analysis practices. She spent 14 years as a forensic scientist at the State Police Lab in Maynard\, MA.  She left in 2022 and uses her training\, knowledge\, and experience to help the defense analyze the strengths and weaknesses of the discovery provided by the Commonwealth. \n  \nRegister for the class by emailing Ellie Hertzberg (erh8@cornell.edu)\, Robyn Larsen (mdalawrobyn@yahoo.com )\, or Veronica Zolina (vzolina@verizon.net).  Please include a phone number in the email so that we can contact you in case of any changes.  If you would like us to inform your county’s bar advocate program about your attendance\, please include your county. \n  \nTime:  Tuesday\, November 7\, 2023 \n4:30 PM – 6:30PM \n  \nPlace: Concord District Court\, 305 Walden St. \n  \nApproved for 2 CLE credits for the criminal trial\, juvenile\, and appellate panels. \n  \nCost: $20 (Pay at the door.  Cash or check payable to CMCBA.) \n [/vc_column_text][/vc_column][/vc_row]

SUMMARY:Working with clients who are Deaf and hard of hearing and their families: a presentation by the Massachusetts Commission for the Deaf and Hard of Hearing (MCDHH)
DESCRIPTION:[vc_row][vc_column][vc_column_text]In Massachusetts and elsewhere in the United States\, access to the courts and legal services by Deaf and hard of hearing individuals remains problematic. This happens for a variety of reasons – insufficient numbers of legal American Sign Language interpreters\, Certified Deaf Interpreters (CDI) and Communication Access Realtime Translation (CART) providers. \nAdditionally\, knowledge related to the provision of appropriate communication access services remains elusive\, as does the proper implementation of such services across a wide spectrum of legal and social services. \nThis presentation by MCDHH will help you to understand what appropriate communication access is; what cultural\, communicative\, procedural and technical considerations to take into account when working with Deaf and hard of hearing individuals and families\, and how MCDHH staff can work with you to ensure positive outcomes for our constituency. \nOrganizer: Deborah Cassell\, CAFL Resource Attorney (Barnstable County)\, deborahcassell_atty@hotmail.com \nZoom link: https://us02web.zoom.us/j/82494978446?pwd=ZGNDc3hDK2tTS0J0dDZLZktJRDFGdz09 \nCLE: 2 CAFL[/vc_column_text][/vc_column][/vc_row]

To receive credits attendees must be logged on during the program for a minimum of 80% of the conference time. DESCRIPTION:[vc_row][vc_column][vc_column_text]Learn how to effectively provide the knowledge\, tools\, and skills individuals with disabilities need to engage in effective self-advocacy in a variety of legal settings. \nFREE ONLINE DISABILITY LAW SEMINAR\nRegister here: https://www.mcle.org/product/catalog/code/2240290WBC?emcampaignID=24824&emuserID=70232&utm_source=Program_Alert&utm_medium=email&utm_campaign=2240290P01&utm_content=24824 \nIndividuals with disabilities must often advocate for themselves or their family members to ensure that they are protected by both federal and Massachusetts laws from discrimination or other forms of abuse in employment\, housing\, and education. The demand for legal assistance in these areas of law continues to increase\, and attorneys who handle these matters often provide guidance or direction that does not rise to the level of full representation but is nonetheless important to help an individual understand their rights and advocate effectively in settings ranging from a workplace\, school\, or living environment to an administrative forum or court. The faculty provide strategies\, tips\, and information to help guide attorneys in providing such assistance based on their professional experiences and years of successful legal advocacy on behalf of individuals with disabilities. \nAgenda \n\nEmployment Discrimination\n\n– Reasonable accommodation requests \n– Interactive process \n– MCAD/EEOC procedures \n– Federal employees \n\nHousing Law\n\n– Reasonable accommodation/Reasonable modification overview \n– Requests and interactive process (Public/subsidized housing grievance/conference and private housing) \n– Complaints: HUD & MCAD; Court (Damages; attorneys’ fees; equitable relief and public interest relief before agency) \n– Evictions: RA defense/counterclaim; Right to jury; Equitable relief; Stay of execution \n– Limited assistance representation \n\nSpecial Education\n\n– Overview of special education rights \n– IEP process \n– 504 plans \n– PRS/BSEA process \n\n“Ask the Experts” Q&A Session\n\nNOTE: 2 CLE credit for each webinar for attorneys on each of the following panels:  CAFL\, and CAFL Appeals[/vc_column_text][/vc_column][/vc_row]

SUMMARY:CAFL's Issue Spotting Training
DESCRIPTION:[vc_row][vc_column][vc_column_text]The Temporary Custody Hearing just ended. DCF has been awarded Temporary Custody. What do you do now? Identifying the potential issues in the case is a critical step for developing a comprehensive case plan. Join us for this zoom training designed to assist you in ferreting out the key issues in your cases. We start with a new\, completely original CAFL hypothetical. And it is packed with issues. Your homework is to read the hypothetical and watch a short video. Then join us on December 6th for the zoom training. After a brief introduction\, we will break into small groups where we can unpack the issues presented in the hypothetical. When we rejoin the large group\, we will compare lists and discuss how to use this list in your case planning. \n2.5 CAFL CLEs \nRegister here: https://us02web.zoom.us/meeting/register/tZ0vce2oqT0sG9UuA2d5_Qg2GHT4pCg9u4NS[/vc_column_text][/vc_column][/vc_row]

SUMMARY:The Center for Guardianship Excellence: Choosing & Using Supported Decision-Making
DESCRIPTION:[vc_row][vc_column][vc_column_text] \nTuesday\, December 12\, 2023\, 1-3 pm Eastern Time. Join us for this 2-hour virtual\, instructor-led workshop to explore Supported Decision-Making from many viewpoints.\nLeave with a clear understanding of the different ways SDM works and what it can mean to the dignity and growth of an adult.\nBy the end of this training\, you will be able to answer these questions: \n1. If someone has incapacities can SDM be chosen instead of guardianship?\n2. What if a guardian has already been appointed\, can SDM be a part of the way decisions are made going forward?\n3.
