SUMMARY:Goetzendanner: the Most Important Case You’ve Never Heard Of
DESCRIPTION:Goetzendanner: the Most Important Case You’ve Never Heard Of\nParole and Sentencing for Defense Attorneys\, Part 1 \nMarch 15\, 2023 1-3pm \nVirtual Training on Zoom \n  \nPlease save the date for the first in a new training series on Parole and Sentencing\, brought to you by the Criminal Defense Trainers and the Parole Advocacy Unit. \n  \nClients charged with new offenses or probation violations while also on parole supervision face a substantial risk that the remainder of their parole sentence will run consecutively to their new sentence – even if the judge and probation clearly promises that it won’t. This problem can cost someone months and even years of additional incarceration\, and it is very difficult to undo. Join us to learn about the implications of Goetzendanner v. Superintendent. By the conclusion of the training\, you will know how to spot and avoid the problem\, educate the judge\, and set your client up for a truly concurrent sentence (while also learning how to pronounce this tremendously important case). \n  \nPresenters: Sentencing expert Lee Gartenberg trains judges on this and many other issues. Criminal defense and parole attorney Nicole Ouellette\, on rotation with the Parole Advocacy Unit\, draws on her background in both areas and has worked closely with Attorney Gartenberg in advising counsel on Goetzendanner problems and other parole-related issues. \nCLE APPROVALS AND REGISTRATION LINK PENDING  – CHECK BACK SOON!

SUMMARY:Protecting the Rights of Parents with Disabilities in Massachusetts – A Conversation with US Department of Justice Attorneys and Coalition Advocates
DESCRIPTION:Title II of the Americans with Disabilities Act protects parents with disabilities from unlawful discrimination in the administration of child welfare programs\, activities\, and services.   In November 2020\, the U.S. Departments of Justice (DOJ) and Health and Human Services (HHS) reached an agreement with the Massachusetts Department of Children and Families (DCF) to resolve findings that DCF discriminated against parents with disabilities in violation of the ADA.  Since November 2020\, the United States has been monitoring DCF’s compliance with the agreement and has been regularly communicating with a coalition of advocates representing Massachusetts agencies and organizations that work with families with disabilities.\nIn this presentation\, DOJ attorneys and coalition members will: 1) explain the general requirements of the ADA in the child welfare context; 2) provide an overview of the violations the Justice Department found during its Massachusetts investigation; 3) discuss the policy and practice changes DCF has had to make pursuant to its agreement with the United States including creating processes for handling accommodation requests and discrimination complaints; 4) explain how individuals can request accommodations or file disability discrimination complaints with DCF (and/or file complaints with DOJ and HHS); and 5) address advocacy strategy and practice tips for attorneys in individual cases; and 6) identify additional resources for attorneys and advocates who work with parents with disabilities. \n2 CAFL CLEs

SUMMARY:Challenges of the First 3 Interviews with a Parent Client
DESCRIPTION:This training focuses on the first few meetings with a new client and the challenges that those meetings present. Topics discussed will include: the time pressure of preparing a new client for a hearing while that client is still dealing with the trauma of removal; role clarification and boundary-setting; reading the signs of past trauma and its impact on a client’s affect during the early interviews; affective (affective\, not effective\, but we hope for that too) messaging during the interview as both support and behavioral response; the way shame\, sadness\, and anger play out in these interviews and some ways to approach and manage\, and then return to the preparation for hearing. It will also touch on the when and how of going thru the petition with the new client as well as role play prep for direct and cross.\nThe format is a directed discussion with Helena Friedman\, Jessica Lang\, Jay Clark\, Lisa Kling and Ellen Broadhurst.\nMarch 28\, 1:00-3:00 pm\, on Zoom\nApproved for 2 CAFL CLEs \nJay Clark is inviting you to a scheduled Zoom meeting. \nTopic: Challenges of the 1st three interviews\nTime: Mar 28\, 2023 01:00 PM Eastern Time (US and Canada) \nJoin Zoom Meeting\nhttps://us02web.zoom.us/j/86055192389?pwd=UEd0VXdIOEFKdU15eEtzb1JEU09sZz09 \nMeeting ID: 860 5519 2389\nPasscode: 169620

SUMMARY:Power of the Jury: The History & Present of Nullification
DESCRIPTION:Let’s talk about how powerful juries can be\, even when presented with strong evidence by the Commonwealth.   \nIn 1851 a group of Bostonians helped free Shadrach Minkins\, who was being jailed in federal custody for violating the Fugitive Slave Act. Though seven were charged\, the government was unable to achieve even one conviction at trial.  Juries still take the power to nullify today. As we know\, the defense is not allowed to argue for nullification\, but this training will help us all find out about some situations where juries choose to nullify and the information jurors may look for in choosing to nullify.   \n   \nFaculty: Connor Barusch & Melanie Roberts   \nCLE: 1 YAD \, 1 ADULT CRIM  \nRegister Here: https://us02web.zoom.us/meeting/register/tZYudeutrzwjGNfdwVTcPR-PbQf42Wmpol3G

SUMMARY:MHLD Raising Racial Bias Issues in your Cases
DESCRIPTION:The MHLD Training Unit\, along with MHLD Staff and Panel Present:\nRaising Racial Bias Issues in your Cases \n Investigate the role of racial bias in the treatment of your client at sectioning\, admission\, and petition phases to demonstrate discriminatory targeting\, disparate treatment and unlawful practices in your commitment and guardianship cases. \nCome join us for this collaborative training examining how to effectively advocate and tell your clients’ stories by exploring the use of racial bias in your case theory. \nApril 14th from 1-3pm on Zoom \n2 CLE Credits: MHLD Trial Panel and MHLD Appellate Panel \n We will begin with an interactive panel discussion to explore: relevant research and data on how race impacts our BIPOC clients disparately in the Mental Health System; the clinical perspective including cultural competency and racial trauma; and how our colleagues have raised race in their cases. \nAfter the panel\, we will then break out into small groups for all to brainstorm practical ways to use our knowledge about the impact of racial bias on the treatment of our clients to litigate race and educate the court in concrete ways. \nAfter the training\, you will be able to: \n\nUnderstand how racial bias impacts our BIPOC clients in commitment and guardianship cases;\nRecognize ways to educate the court about the impact of racial bias on our clients which results in inaccurate diagnosis and inequitable treatment; and\nIdentify effective cross & direct examination chapters that reflect the impact of racial bias\n\nRegister in advance for this meeting: \nhttps://us02web.zoom.us/meeting/register/tZcpdOmppz0uGdCyjKgZ8ZqcYx0i76g3hCSj \nAfter registering\, you will receive a confirmation email containing information about joining the meeting. \n
