SUMMARY:Challenges of the First 3 Interviews with a Parent Client
DESCRIPTION:This training focuses on the first few meetings with a new client and the challenges that those meetings present. Topics discussed will include: the time pressure of preparing a new client for a hearing while that client is still dealing with the trauma of removal; role clarification and boundary-setting; reading the signs of past trauma and its impact on a client’s affect during the early interviews; affective (affective\, not effective\, but we hope for that too) messaging during the interview as both support and behavioral response; the way shame\, sadness\, and anger play out in these interviews and some ways to approach and manage\, and then return to the preparation for hearing. It will also touch on the when and how of going thru the petition with the new client as well as role play prep for direct and cross.\nThe format is a directed discussion with Helena Friedman\, Jessica Lang\, Jay Clark\, Lisa Kling and Ellen Broadhurst.\nMarch 28\, 1:00-3:00 pm\, on Zoom\nApproved for 2 CAFL CLEs \nJay Clark is inviting you to a scheduled Zoom meeting. \nTopic: Challenges of the 1st three interviews\nTime: Mar 28\, 2023 01:00 PM Eastern Time (US and Canada) \nJoin Zoom Meeting\nhttps://us02web.zoom.us/j/86055192389?pwd=UEd0VXdIOEFKdU15eEtzb1JEU09sZz09 \nMeeting ID: 860 5519 2389\nPasscode: 169620

SUMMARY:Power of the Jury: The History & Present of Nullification
DESCRIPTION:Let’s talk about how powerful juries can be\, even when presented with strong evidence by the Commonwealth.   \nIn 1851 a group of Bostonians helped free Shadrach Minkins\, who was being jailed in federal custody for violating the Fugitive Slave Act. Though seven were charged\, the government was unable to achieve even one conviction at trial.  Juries still take the power to nullify today. As we know\, the defense is not allowed to argue for nullification\, but this training will help us all find out about some situations where juries choose to nullify and the information jurors may look for in choosing to nullify.   \n   \nFaculty: Connor Barusch & Melanie Roberts   \nCLE: 1 YAD \, 1 ADULT CRIM  \nRegister Here: https://us02web.zoom.us/meeting/register/tZYudeutrzwjGNfdwVTcPR-PbQf42Wmpol3G

SUMMARY:2023 Why Race Matters Speaker Series: Community Groups
DESCRIPTION:This year our series focuses on how we engage and work with communities to tackle the issues of racial inequity in our legal systems.  Participants leave with an understanding of the continuously evolving complexities of race in our criminal legal\, juvenile\, family regulation and mental health systems and how working collaboratively with community can mitigate the impact of the history of segregation and white supremacy in America\, as it influences the legal systems in which we work.\nhttps://www.eventbrite.com/e/cpcs-training-dept-presents-why-race-matters-spring-2023-speaker-series-registration-532234376347 \n\n\n\n\n\n\n\n\nCPCS Training Dept. Presents: Why Race Matters – Spring 2023 Speaker Series\nTheresa Coney\, CPCS Training Department Racial Equity Training Lead\, presents a speaker series advancing racial equity and justice.\nwww.eventbrite.com\n\n\n\n\n\n\nCommunity Resource Panel: Understanding Community and Collaboration \nCommunity Organizations: \nMore Than Words\, One Can Help\, PPAL\, ROCA\, Transformational Prison Project\, Wildflower Alliance \, KIVA Center\, La Collaborativa (formerly Chelsea Collaborative) \nDate: April 24\, 2021\, 1-3pm; Breakout 2-3pm \nEngaging with the community is an important asset in the work of understanding why race matters. The Commonwealth of Massachusetts has a number of organizations who have worked among and within community\, to understand the needs of our clients and work to address those concerns. We have gathered a group of such organization to speak to participants about the wealth of services that they can provide for our clients within the community and how to access such services. These organization will engage with participants in a discussion about how race and equity impacts their work\, their services and their community. Following a preliminary introduction of each organization\, participants can choose which organization they would like to hear more from and join that organization in a breakout room.

SUMMARY:MCLE – Toxicology for Lawyers: Drug & Alcohol Testing
DESCRIPTION:MCLE – Toxicology for Lawyers: Drug & Alcohol Testing\n4/25/2023 \n2-5pm \nThis program is hosted by the organizer listed below. Any questions or issues regarding this program should be directed there. This event is being listed for informational purposes only. CPCS staff cannot assist with\, or solve\, registration issues. \nToxicology for Lawyers: Drug & Alcohol Testing: Understanding the Principles and Interpreting the Results of Toxicological Testing in your Cases. \nUnderstanding drug and alcohol testing is an important aspect of legal practice. Learning how to interpret results (and knowing when to consult with an expert) from these methods and analyses is vital to the success of many cases\, whether cases in adult criminal or juvenile court\, child custody or other care and protection cases\, violation of probation hearings\, or other legal matters involving drug or alcohol evidence. Allegations of drugs or alcohol use and mis-use are not always supported by the weight of relevant scientific evidence. Weighing that evidence involves a detailed understanding of testing methods – both “screening level” and “confirmatory” tests – their strengths and weaknesses\, and why they can provide ambiguous results. This is especially true of tests involving opiates and amphetamines. Testing for ethyl alcohol – whether in people’s breath\, urine\, or blood – can yield more straightforward results\, but the proper extrapolation of those results involves a detailed understanding of the pharmacokinetics of ethanol and the testing methods’ shortcomings. Understanding and interpreting the results will generally require detailed laboratory reports and medical records – even such an apparently simple process as weighing suspected drug samples may not be as straightforward as it appears. \n  \nJoin our experts as we look at the fields of analytical chemistry\, toxicology\, pharmacokinetics\, and statistics\, and their roles in both criminal and care & protection cases. Learn how to evaluate the evidence\, know when to obtain and use your own experts\, and practical litigation tips. \n  \nhttps://www.mcle.org/

SUMMARY:White Collar Criminal Cases at The State Court Level
DESCRIPTION:The proliferation of smartphone and mobile computing technology has resulted in society’s dependence on the creation and exchange of electronically stored information.  People store a substantial amount of private information on their mobile devices.  Plastic credit cards are being replaced by their digital counterparts using “near field communication” technology at the cash register. Motor vehicles contain their own internal computers with “infotainment” data.  Security systems connect with users across the cloud. Daily life occurs on the “ground\,” but many routine transactions and interactions occur in the “cloud.”  As a result\, the definition of the “white collar” criminal case has evolved making it more routine at the state court level.  The procedural and evidentiary issues these cases present can be streamlined and organized once identified.\nThe following are some of the topics this program will cover accompanied by a “View from the Bench”: \n\nIdentifying automatic discovery under Mass. R. Crim. P. 14\nDrafting and litigating the pretrial production of third-party records under Mass. R. Crim. P. 17\nDocument management and review tools\nCell Site Location Information (“CSLI”)\, social media evidence\, motor vehicle data\, and the Internet of Things (“IoT”)\nExpert witnesses and forensics\nTrial preparation and presentation\n\nFaculty:\nHon. Matthew Machera\, First Justice\, Chelsea District Court\nADA Greg Connor\, Norfolk County DA’s Office\nDaniel Gelb\, Esq.\, Gelb & Gelb LLP \nOnline Only\nCPCS has approved this program for 2.0 CLE credits.
