DESCRIPTION:Goetzendanner: the Most Important Case You’ve Never Heard Of\nParole and Sentencing for Defense Attorneys\, Part 1 \nMarch 15\, 2023 1-3pm \nVirtual Training on Zoom \n  \nPlease save the date for the first in a new training series on Parole and Sentencing\, brought to you by the Criminal Defense Trainers and the Parole Advocacy Unit. \n  \nClients charged with new offenses or probation violations while also on parole supervision face a substantial risk that the remainder of their parole sentence will run consecutively to their new sentence – even if the judge and probation clearly promises that it won’t. This problem can cost someone months and even years of additional incarceration\, and it is very difficult to undo. Join us to learn about the implications of Goetzendanner v. Superintendent. By the conclusion of the training\, you will know how to spot and avoid the problem\, educate the judge\, and set your client up for a truly concurrent sentence (while also learning how to pronounce this tremendously important case). \n  \nPresenters: Sentencing expert Lee Gartenberg trains judges on this and many other issues. SUMMARY:Protecting the Rights of Parents with Disabilities in Massachusetts – A Conversation with US Department of Justice Attorneys and Coalition Advocates
DESCRIPTION:Title II of the Americans with Disabilities Act protects parents with disabilities from unlawful discrimination in the administration of child welfare programs\, activities\, and services.   In November 2020\, the U.S. Departments of Justice (DOJ) and Health and Human Services (HHS) reached an agreement with the Massachusetts Department of Children and Families (DCF) to resolve findings that DCF discriminated against parents with disabilities in violation of the ADA.  Since November 2020\, the United States has been monitoring DCF’s compliance with the agreement and has been regularly communicating with a coalition of advocates representing Massachusetts agencies and organizations that work with families with disabilities.\nIn this presentation\, DOJ attorneys and coalition members will: 1) explain the general requirements of the ADA in the child welfare context; 2) provide an overview of the violations the Justice Department found during its Massachusetts investigation; 3) discuss the policy and practice changes DCF has had to make pursuant to its agreement with the United States including creating processes for handling accommodation requests and discrimination complaints; 4) explain how individuals can request accommodations or file disability discrimination complaints with DCF (and/or file complaints with DOJ and HHS); and 5) address advocacy strategy and practice tips for attorneys in individual cases; and 6) identify additional resources for attorneys and advocates who work with parents with disabilities. \n2 CAFL CLEs

SUMMARY:Challenges of the First 3 Interviews with a Parent Client
DESCRIPTION:This training focuses on the first few meetings with a new client and the challenges that those meetings present. Topics discussed will include: the time pressure of preparing a new client for a hearing while that client is still dealing with the trauma of removal; role clarification and boundary-setting; reading the signs of past trauma and its impact on a client’s affect during the early interviews; affective (affective\, not effective\, but we hope for that too) messaging during the interview as both support and behavioral response; the way shame\, sadness\, and anger play out in these interviews and some ways to approach and manage\, and then return to the preparation for hearing. CPCS staff cannot assist with\, or solve\, registration issues.\nThis presentation is geared towards MA advocates who work with incarcerated people who are seeking medical parole based on a permanent cognitive incapacitation\, but may also be helpful for anyone working with incarcerated elders or those with cognitive disabilities. \nThe purpose of this presentation is to provide a basic overview of: \n\nThe types of neurocognitive conditions common among incarcerated elders and the physiological origins of these conditions\nHow to spot signs of cognitive impairment\nThe different types of neurocognitive evaluation tools that providers use to assess cognitive impairments and challenges to their administration in a carceral setting\nBest practices for medical advocacy and medical parole affidavit letters\n\nNote that this presentation includes short mandatory anonymous pre- and post-presentation surveys. \nDisclosure: This presentation\, facilitated by Prisoners’ Legal Services of MA\, is being provided in partnership with Dr. Rose Onyeali and Ang Le of UPenn School of Medicine and Lance Washington of the National Association of State Mental Health Program Directors – Research Institute (NRI).
