SUMMARY:Mental Health Litigation Training: Refresh and Hone Your Cross Exam Skills
DESCRIPTION:Mental Health Litigation Training Unit Presents (again):\nRefresh and Hone Your Cross Exam Skills:\nUsing trial transcripts to demonstrate effective ways to conduct a powerful cross \n In all your cases\, you need to conduct strategic and effective cross examination in order to successfully argue why the court should deny the petitioner’s case. What better way to improve your cross skills than to view transcripts of actual cross examinations for what to emulate and what to improve? \nCome join us on February 10th from 2-4 p.m. \n2 CLE Credits (MH trial and appellate panels) \n We will discuss and review fundamental cross examination technique\, theory and strategy\, and demonstrate a problematic cross followed by an improved examination. We will then break out into small groups facilitated by MHLD staff to review transcripts together to identify which cross exams were effective and practice conducting cross exams to make others more effective. \n After the training\, you will be able to: \n\nExplain when & why to use a constructive or destructive cross technique and your theory of the case & witness;\nIdentify the Three Rules of Cross;\nRecognize good and bad examples of effective cross examination;\nDemonstrate how to correct the ineffective sample cross examinations with proper cross technique\n\nRegistration is limited to 40 participants because there is brainstorming and “on your feet” skills practice in small groups. This is the same program that was offered in February 2022 so please do not register for this again if you took the program last year. If we end up having space we will open to repeat participants. \nRegister in advance for this meeting: \nhttps://us02web.zoom.us/meeting/register/tZErd-GopjwqHtcOaQgMrVZG30R3wIPz0pCe \nAfter registering\, you will receive a confirmation email containing your unique link to join the training on February 10 at 2:00 p.m. Please save that email/copy link to your calendar and do not share it with others.

SUMMARY:Lunch and Learn with CAFL Legal Response Team on DCF's Disability Policy
DESCRIPTION:Upcoming Webinar! A Year Later:  Sharing your Experiences with DCF’s Disability Policy\, February 6 from 1-2PM.\nIn the year since DCF’s Disability Policy was released\, many attorneys have tried to use the policy to ensure that DCF meets its obligations to provide parents and children with disabilities the supports and services they need. In doing so\, attorneys have identified some common issues with the policy and its implementation. For example\, despite the policy’s requirement that DCF work collaboratively with parents to create an action plan that provides reasonable accommodations and services that are appropriate for that individual parent\, DCF often fails to do so. \nThe Family Law Project of the Mental Health Legal Advisors Committee (MHLAC) is interested in challenging the policy and would like to hear from CAFL attorneys about their experiences to inform their efforts. Join the CAFL Legal Response team for a virtual lunch and learn on February 6\, 2023 from 1-2PM to discuss DCF’s Disability Policy with attorneys from MHLAC. In addition to reviewing the highlights of the policy\, we will learn about MHLAC’s efforts and participants will have an opportunity to share their experiences.  Attendees will receive 1 CLE. \nPlease register in advance using this link: https://us02web.zoom.us/meeting/register/tZYrcu2uqTgpGdf3DaO4USGdFl6rz1ZeXi47 \nIf you have any questions\, please contact Lisa Augusto at laugusto@localhost/cpcs.

SUMMARY:Jake J. Go Away: Challenging Release Conditions ordered under c. 276\, § 87
DESCRIPTION:Children charged with crimes in Massachusetts are often subjected to onerous pretrial conditions pursuant to G.L. c. 276\, § 87\, which permits judges to impose any pretrial condition of release if the youth consents to its imposition. These conditions are monitored by probation officers\, who receive school reports\, demand urine tests for drug screens\, talk to parents and DCF workers about behaviors at home\, and bring forth violation proceedings subjecting youth to DYS detention for up to 90 days—all before a youth has been adjudicated delinquent or pleaded to sufficient facts. And\, often\, a youth’s “consent” to such conditions is coerced by the threat of detention.\nThis training will explore how to strategically challenge conditions imposed under § 87 in Juvenile Courts. Materials will include a sample motion with accompanying affidavits\, a Quick Reference Guide and a sample 211/3. \nTopic: Jake J. Go Away: Challenging Release Conditions ordered under c. 276\, § 87\nTime: Feb 1\, 2023\, 02:00 PM Eastern Time (US and Canada) \nRegistration Link:\n\nhttps://us02web.zoom.us/meeting/register/tZModeisrjwoH9UpYEKBRY87feWtl9A08xKl

SUMMARY:Part 2 of the Cultural Humility Series: Legal Resources for Families Preparing Parent Clients to Testify
DESCRIPTION:Preparing Parent Clients to Testify at TrialJanuary 26\, 2023\, 3:00-4:30 \nPresenters: Victoria Bleier\, Private Practice\, Berkshire County and Eleanor Wilkinson\, Staff Attorney\, Pittsfield \nYour client is nervous. Please join Eleanor and Tori in a “reprisal” of their much-applauded presentation at the 2021 National Association of Counsel for Children’s annual conference. This session will help participants build a solid foundation for their relationship with a parent client.
