SUMMARY:Lunch and Learn with CAFL Legal Response Team on DCF's Disability Policy
DESCRIPTION:Upcoming Webinar! A Year Later:  Sharing your Experiences with DCF’s Disability Policy\, February 6 from 1-2PM.\nIn the year since DCF’s Disability Policy was released\, many attorneys have tried to use the policy to ensure that DCF meets its obligations to provide parents and children with disabilities the supports and services they need. In doing so\, attorneys have identified some common issues with the policy and its implementation. For example\, despite the policy’s requirement that DCF work collaboratively with parents to create an action plan that provides reasonable accommodations and services that are appropriate for that individual parent\, DCF often fails to do so. \nThe Family Law Project of the Mental Health Legal Advisors Committee (MHLAC) is interested in challenging the policy and would like to hear from CAFL attorneys about their experiences to inform their efforts. Join the CAFL Legal Response team for a virtual lunch and learn on February 6\, 2023 from 1-2PM to discuss DCF’s Disability Policy with attorneys from MHLAC. In addition to reviewing the highlights of the policy\, we will learn about MHLAC’s efforts and participants will have an opportunity to share their experiences.  Attendees will receive 1 CLE. \nPlease register in advance using this link: https://us02web.zoom.us/meeting/register/tZYrcu2uqTgpGdf3DaO4USGdFl6rz1ZeXi47 \nIf you have any questions\, please contact Lisa Augusto at laugusto@localhost/cpcs.

SUMMARY:Protecting the Rights of Parents with Disabilities in Massachusetts – A Conversation with US Department of Justice Attorneys and Coalition Advocates
DESCRIPTION:Title II of the Americans with Disabilities Act protects parents with disabilities from unlawful discrimination in the administration of child welfare programs\, activities\, and services.   In November 2020\, the U.S. Departments of Justice (DOJ) and Health and Human Services (HHS) reached an agreement with the Massachusetts Department of Children and Families (DCF) to resolve findings that DCF discriminated against parents with disabilities in violation of the ADA.  Since November 2020\, the United States has been monitoring DCF’s compliance with the agreement and has been regularly communicating with a coalition of advocates representing Massachusetts agencies and organizations that work with families with disabilities.\nIn this presentation\, DOJ attorneys and coalition members will: 1) explain the general requirements of the ADA in the child welfare context; 2) provide an overview of the violations the Justice Department found during its Massachusetts investigation; 3) discuss the policy and practice changes DCF has had to make pursuant to its agreement with the United States including creating processes for handling accommodation requests and discrimination complaints; 4) explain how individuals can request accommodations or file disability discrimination complaints with DCF (and/or file complaints with DOJ and HHS); and 5) address advocacy strategy and practice tips for attorneys in individual cases; and 6) identify additional resources for attorneys and advocates who work with parents with disabilities. \n2 CAFL CLEs

SUMMARY:Power of the Jury: The History & Present of Nullification
DESCRIPTION:Let’s talk about how powerful juries can be\, even when presented with strong evidence by the Commonwealth.   \nIn 1851 a group of Bostonians helped free Shadrach Minkins\, who was being jailed in federal custody for violating the Fugitive Slave Act. Though seven were charged\, the government was unable to achieve even one conviction at trial.  Juries still take the power to nullify today. As we know\, the defense is not allowed to argue for nullification\, but this training will help us all find out about some situations where juries choose to nullify and the information jurors may look for in choosing to nullify.   \n   \nFaculty: Connor Barusch & Melanie Roberts   \nCLE: 1 YAD \, 1 ADULT CRIM  \nRegister Here: https://us02web.zoom.us/meeting/register/tZYudeutrzwjGNfdwVTcPR-PbQf42Wmpol3G

SUMMARY:White Collar Criminal Cases at The State Court Level
DESCRIPTION:The proliferation of smartphone and mobile computing technology has resulted in society’s dependence on the creation and exchange of electronically stored information.  People store a substantial amount of private information on their mobile devices.  Plastic credit cards are being replaced by their digital counterparts using “near field communication” technology at the cash register. Motor vehicles contain their own internal computers with “infotainment” data.  Security systems connect with users across the cloud. Daily life occurs on the “ground\,” but many routine transactions and interactions occur in the “cloud.”  As a result\, the definition of the “white collar” criminal case has evolved making it more routine at the state court level.  The procedural and evidentiary issues these cases present can be streamlined and organized once identified.\nThe following are some of the topics this program will cover accompanied by a “View from the Bench”: \n\nIdentifying automatic discovery under Mass. R. Crim. P. 14\nDrafting and litigating the pretrial production of third-party records under Mass. R. Crim. P. 17\nDocument management and review tools\nCell Site Location Information (“CSLI”)\, social media evidence\, motor vehicle data\, and the Internet of Things (“IoT”)\nExpert witnesses and forensics\nTrial preparation and presentation\n\nFaculty:\nHon. Matthew Machera\, First Justice\, Chelsea District Court\nADA Greg Connor\, Norfolk County DA’s Office\nDaniel Gelb\, Esq.\, Gelb & Gelb LLP \nOnline Only\nCPCS has approved this program for 2.0 CLE credits.

SUMMARY:Adulting for Lawyers: Crushing that Awkward Phase when you Represent Emerging Adults\, Part II – Effective Communication and Holistic Representation and Advocacy
DESCRIPTION:This is the second session of a virtual three-part series that will help CAFL practitioners navigate zealously representing youth and young adults age 16 – 22. This session will focus on how to communicate effectively\, how to identify the client’s skills and needs and find resources to advocate for from DCF. The session will include: a presentation on adolescent brain development and working with transition age youth clients; a panel on client communication and how it may change as the client and their case change; holistic representation\, supports and services; a breakout session on barriers to advocacy; and a conversation with a transition age youth and her parent on what worked and what did not work in her professional relationship with her lawyer. Approved for 3 CAFL CLEs.Register HERE!
