SUMMARY:Protecting the Rights of Parents with Disabilities in Massachusetts – A Conversation with US Department of Justice Attorneys and Coalition Advocates
DESCRIPTION:Title II of the Americans with Disabilities Act protects parents with disabilities from unlawful discrimination in the administration of child welfare programs\, activities\, and services.   In November 2020\, the U.S. Departments of Justice (DOJ) and Health and Human Services (HHS) reached an agreement with the Massachusetts Department of Children and Families (DCF) to resolve findings that DCF discriminated against parents with disabilities in violation of the ADA.  Since November 2020\, the United States has been monitoring DCF’s compliance with the agreement and has been regularly communicating with a coalition of advocates representing Massachusetts agencies and organizations that work with families with disabilities.\nIn this presentation\, DOJ attorneys and coalition members will: 1) explain the general requirements of the ADA in the child welfare context; 2) provide an overview of the violations the Justice Department found during its Massachusetts investigation; 3) discuss the policy and practice changes DCF has had to make pursuant to its agreement with the United States including creating processes for handling accommodation requests and discrimination complaints; 4) explain how individuals can request accommodations or file disability discrimination complaints with DCF (and/or file complaints with DOJ and HHS); and 5) address advocacy strategy and practice tips for attorneys in individual cases; and 6) identify additional resources for attorneys and advocates who work with parents with disabilities. \n2 CAFL CLEs

SUMMARY:White Collar Criminal Cases at The State Court Level
DESCRIPTION:The proliferation of smartphone and mobile computing technology has resulted in society’s dependence on the creation and exchange of electronically stored information.  People store a substantial amount of private information on their mobile devices.  Plastic credit cards are being replaced by their digital counterparts using “near field communication” technology at the cash register. Motor vehicles contain their own internal computers with “infotainment” data.  Security systems connect with users across the cloud. Daily life occurs on the “ground\,” but many routine transactions and interactions occur in the “cloud.”  As a result\, the definition of the “white collar” criminal case has evolved making it more routine at the state court level.  The procedural and evidentiary issues these cases present can be streamlined and organized once identified.\nThe following are some of the topics this program will cover accompanied by a “View from the Bench”: \n\nIdentifying automatic discovery under Mass. SUMMARY:CAFL Trial Panel Certification Training Fall 2023 Orientation
DESCRIPTION:[vc_row][vc_column][vc_column_text]CPCS is now accepting applications for its Fall 2023 CAFL Trial Panel Certification Training to represent children and parents in care and protection/termination of parental rights and child requiring assistance (CRA) cases. The training includes full day in-person sessions\, half-day live zoom sessions\, and substantial self-directed learning. The training concludes with a full day in-person mock temporary custody hearing.  Attorneys accepted into this training will receive a “Certification Payment” of $5032 upon the following: 1) successful completion of the CAFL Trial Panel Certification Training; and 2) within twelve months of completing the training the attorney (a) receives appointments on 12 care and protection cases\, and (b) submits 600 hours of billing on care and protection cases. \nCPCS is committed to ensuring that the panel of attorneys accepting CAFL assignments is sensitive to the diversity of the client population it serves.  We will give preference on a rolling basis to attorneys who submit completed applications by Wednesday\, July 26\, 2023\, although we will continue to accept applications after that time.  We encourage interested attorneys to apply early and not wait until the deadline.
