ACLUM often sends public records requests to investigate discrete legal issues\, to preserve access to a free and open government\, or to aid in litigation efforts. CPCS staff cannot assist with\, or solve\, registration issues.\nHow We EndUp: A Future Without Family Policing Convening  \nThe UpEnd Movement is holding its 2nd annual convening of organizers\, activists\, scholars\, and community leaders who are committed to dismantling the family policing system\, a system predicated on the subjugation\, surveillance\, control\, and punishment of mostly poor Black and Native children and families.  The conference will commence with a keynote presentation by Derecka Purnell\, human rights lawyer\, organizer\, and author of Becoming Abolitionist\, in conversation with scholar\, social justice activist and author of the seminal book Shattered Bonds: The Color of Child Welfare\, Dorothy Roberts.  It will bring these voices together to explore how we can move toward abolition of family policing—how we can dismantle harmful\, racist systems and build different ways of caring for one another. \nThe conference will be held October 26-27 from 1:00-4:15pm Tuesday and Wednesday.  It’s approved for 3 CAFL CLEs each day and you can register here.

Please register here: https://us02web.zoom.us/meeting/register/tZUrdOChrzsqGNRgP4jzDhQLoS6odpdT7rg0 \nThe program has been approved for 1 CLE for Adult Criminal\, Criminal Appeals\, YAD and YAD Appeals and Mental Health \nPlease join us for a Brown Bag refresher and discussion by the Criminal Defense Training Unit about Section 35s and representing people who are being arrested in the City’s assault on the community of unhoused people in the area of Mass and Cass. We will have a presentation and discussion on strategies to zealously represent our clients\, protecting both their rights and their lives\, in the face of Section 35 petitions and warrant arrests. Sample motions\, appealing Section 35 commitments\, objections and defenses unique to this circumstance and working with medically compromised clients will also be covered. \nBackground: Nov 1st the Trial Court will open a “court” inside the Suffolk County House of Corrections\, which will operate Mondays\, Tuesday and Wednesdays. This will be used to book and process people arrested as part of the ongoing sweeps of the Mass and Cass area. We expect a substantial number of arrests over the coming weeks\, and for those arrests to be used as a pretext to get people off the street and into state custody for Section 35s to be filed. Section 35s may not be medically advisable or in the best interests of our clients. See this article quoting local doctors highlight the risks associated with the city’s plan for more background: https://www.boston.com/news/local-news/2021/10/21/experts-concerned-kim-janey-mass-cass-executive-order-encampments/  Bar advocates and CPCS staff will be covering duty days within this jail/court. \nThe choice of South Bay HOC as the location where court will be conducted and people will be held for booking is very troubling\, particularly given the four people who died there between June and September\, including one woman detained for a section 35. \nMore details are coming out every day about this plan by the city/police/courts\, so our responses to protect our clients and stand against this injustice are also evolving. We will continue to monitor the developments\, share information and provide support as this unfolds. Thanks for being in this fight together! \n  \n

It’s not your skillful direct. It’s not how many of your impassioned objections the judge sustains. It’s not your confident demeanor. It’s not even how you tie your theory of the case together with a dazzling closing statement bow. \nWhat wins your trial is your cross. \nCross-examination is the single most important element of a trial well-conducted. When you learn to do it right\, Larry Pozner says\, you accomplish four critical goals: (1) you amp up the witness’s voice to relate each fact of your story to the jury; (2) you break that story down into clear\, veridical “chapters”—factual building blocks that trigger and channel jury cognitions; (3) you construct logical\, semantic links between your opening and closing—links necessary for the jury to resonate with your theory of the case; and (4) you use witness emotion—like anxiety—to reconstruct fading memories\, compel honesty\, eliminate distortions\, close down paths to irrational outcomes\, and empower your jury to reach a clear decision. \nPozner shares signature techniques well-grounded in current thinking about the neuroscience of decision\, memory\, and emotion. SUMMARY:Motion in Limine practice in the Berkshires
DESCRIPTION:In this one-hour training\, Emily Herder and Dorothy Storrow will discuss the ins and outs of Motion in Limine practice in the Berkshires.  Participants will receive Attorney Herder’s extensively researched model motion and memo of law.  These pleadings can be used as a starting point for your motions in limine.  They also provide an extensive review of the evidentiary law governing admission of documentary evidence in CAFL proceedings.  Learn how Attorney Herder has used this model to streamline drafting motions in limine.  Hone your arguments to successfully argue for specific and timely rulings by learning why summary rulings and delayed rulings each violate your client’s due process rights.  Discuss some of the critical case law and find out how the judges have been ruling on various objections.  Join your peers in a discussion of winning and losing strategies.  It is a lot to cover in an hour – but we will do our best to make it enjoyable (at least far more enjoyable than drafting motions in limine without this great tool).  And we will do our best to answer your questions.\n  \nPLEASE REGISTER via email to: DOROTHY M. DESCRIPTION:n Massachusetts and elsewhere in the United States\, access to the courts and legal services by Deaf and hard of hearing individuals remains problematic. This happens for a variety of reasons – insufficient numbers of legal American Sign Language interpreters\, Certified Deaf Interpreters (CDI) and Communication Access Realtime Translation (CART) providers.\nAdditionally\, knowledge related to the provision of appropriate communication access services remains elusive\, as does the proper implementation of such services across a wide spectrum of legal and social services. \nThis presentation by MCDHH will help you to understand what appropriate communication access is; what cultural\, communicative\, procedural and technical considerations to take into account when working with Deaf and hard of hearing individuals and families\, and how MCDHH staff can work with you to ensure positive outcomes for our constituency.

Colleagues in the majority will learn of challenges that diverse and underrepresented colleagues face in responding\, as well as the collateral harm resulting from bias fraught engagements.
