DESCRIPTION:Let’s talk about how powerful juries can be\, even when presented with strong evidence by the Commonwealth.   \nIn 1851 a group of Bostonians helped free Shadrach Minkins\, who was being jailed in federal custody for violating the Fugitive Slave Act. Though seven were charged\, the government was unable to achieve even one conviction at trial.  Juries still take the power to nullify today. SUMMARY:White Collar Criminal Cases at The State Court Level
DESCRIPTION:The proliferation of smartphone and mobile computing technology has resulted in society’s dependence on the creation and exchange of electronically stored information.  People store a substantial amount of private information on their mobile devices.  Plastic credit cards are being replaced by their digital counterparts using “near field communication” technology at the cash register. Motor vehicles contain their own internal computers with “infotainment” data.  Security systems connect with users across the cloud. Daily life occurs on the “ground\,” but many routine transactions and interactions occur in the “cloud.”  As a result\, the definition of the “white collar” criminal case has evolved making it more routine at the state court level.  The procedural and evidentiary issues these cases present can be streamlined and organized once identified.\nThe following are some of the topics this program will cover accompanied by a “View from the Bench”: \n\nIdentifying automatic discovery under Mass. R. Crim. P. 14\nDrafting and litigating the pretrial production of third-party records under Mass. R. Crim.
