SUMMARY:FEDERAL LEGISLATIVE HISTORY CLE
DESCRIPTION:This program is hosted by the Social Law. Any questions or issues regarding this program should be directed there. This event is being listed for informational purposes only. CPCS staff cannot assist with\, or solve\, registration issues.\n\n\n\nFEDERAL LEGISLATIVE HISTORY CLE \nThursday\, December 2\, 2021 \n4:00 p.m. – 6:00 p.m. \nPanel\nAlex G. Philipson\, Esq. – Deputy Legal Counsel\, Massachusetts Superior Court\nBrian J. Harkins\, Esq. – Senior Reference Attorney\, Social Law Library \nOnline Only \nLegislative history is a critically important advocacy tool in Federal Court when statutory language is ambiguous and begs for clarification. Federal judges invite and apply the use of legislative history to avoid incongruous results\, illuminate drafting errors\, determine specialized meanings\, or choose reasonable interpretations of politically controversial statutes.\nIn these and other instances\, Congress’s intent must be inferred from the statute’s legislative history\, which successful advocate’s must stitch together from a variety of sources including:\n– The text of the bill and proposed amendments that were accepted or rejected\n– Transcripts of hearings conducted by Congressional committees responsible for the bill\n– Committee reports written about the bill\n– Transcripts of House and Senate floor debates related to the bill \nAlex Philipson\, who has taught classes in appellate writing at New England Law Boston and Northeastern University Law School\, and Senior Reference Attorney Brian Harkins will show the “how” and “where” to find and interpret these and other sources of legislative history. \nThis program teaches advocates the research skills necessary to reconstruct a statute’s legislative history for use in pleadings\, briefs and oral arguments. \n2 CLE: CAFL\, Adult Criminal\, MHLD\, YAD

SUMMARY:Webinar on the SJC’s Game-Changing Decision in Care and Protection of Rashida
DESCRIPTION:Webinar on the SJC’s Game-Changing Decision in Care and Protection of Rashida\nOn the heels of the SJC’s watershed decision in Care and Protection of Walt comes what many were calling Walt II until the decision came down as Care and Protection of Rashida.  After years of fighting for judges to hear reasonable efforts motions\, the SJC came through for Massachusetts families and issued this game-changing decision.  So what now?  Come hear about Rashida and why it is game-changing from Attorneys Ann O’Connor and William Comeau\, who represented Rashida and her mother in the SJC.  They will review the decision and provide practical tips on how to use it to force DCF to do their job and make reasonable efforts to reunify families.  They will explain how the decision builds on Ann’s success in Walt\, and says that parents and children can challenge DCF’s failure to make reasonable efforts and request remedial orders any time in the case.  We will learn how to frame challenges to reasonable efforts to get the most for our clients and support reunification of families. \nRegister

SUMMARY:ACLUM Public Records Requests Training
DESCRIPTION:This program is hosted by ACLU. Any questions or issues regarding this program should be directed there. (info@aclum.org). This event is being listed for informational purposes only. CPCS staff cannot assist with\, or solve\, registration issues.\nWe are writing to offer an opportunity to join the ACLU of Massachusetts on Tuesday\, October 19\, at 4 p.m.\, for a remote training on making\, pursuing\, and litigating requests under the Massachusetts Public Records Law. \nThis law is a critical tool to help people learn what their government is doing. ACLUM often sends public records requests to investigate discrete legal issues\, to preserve access to a free and open government\, or to aid in litigation efforts. We also receive many requests—more than we can handle ourselves—for help from people who want to submit their own public records requests\, or have already done so without success. Consequently\, we frequently have projects where we might need your assistance gathering records. \nAs part of this training\, you’ll learn about:\n• Crafting a request under the Massachusetts Public Records Law\n• Following up with a public entity about a request\n• Litigating a request when the public entity’s response is inadequate\n• Evaluating and responding to the assertion of exemptions \nREGISTER HERE \n1 CLE – YAD\, YAD APPEALS\, ADULT CRIMINAL\, CRIMINAL APPEALS\, SORB/SDP\, CAFL\, Mental Health

SUMMARY:Mass and Cass Legal: Section 35s and Beyond
DESCRIPTION:Mass and Cass Legal: Section 35\, Warrants and Beyond\n October 27th 2021\, 1-2pm. Please register here: https://us02web.zoom.us/meeting/register/tZUrdOChrzsqGNRgP4jzDhQLoS6odpdT7rg0 \nThe program has been approved for 1 CLE for Adult Criminal\, Criminal Appeals\, YAD and YAD Appeals and Mental Health \nPlease join us for a Brown Bag refresher and discussion by the Criminal Defense Training Unit about Section 35s and representing people who are being arrested in the City’s assault on the community of unhoused people in the area of Mass and Cass. We will have a presentation and discussion on strategies to zealously represent our clients\, protecting both their rights and their lives\, in the face of Section 35 petitions and warrant arrests. Sample motions\, appealing Section 35 commitments\, objections and defenses unique to this circumstance and working with medically compromised clients will also be covered. \nBackground: Nov 1st the Trial Court will open a “court” inside the Suffolk County House of Corrections\, which will operate Mondays\, Tuesday and Wednesdays. This will be used to book and process people arrested as part of the ongoing sweeps of the Mass and Cass area. We expect a substantial number of arrests over the coming weeks\, and for those arrests to be used as a pretext to get people off the street and into state custody for Section 35s to be filed. Section 35s may not be medically advisable or in the best interests of our clients. See this article quoting local doctors highlight the risks associated with the city’s plan for more background: https://www.boston.com/news/local-news/2021/10/21/experts-concerned-kim-janey-mass-cass-executive-order-encampments/  Bar advocates and CPCS staff will be covering duty days within this jail/court. \nThe choice of South Bay HOC as the location where court will be conducted and people will be held for booking is very troubling\, particularly given the four people who died there between June and September\, including one woman detained for a section 35. \nMore details are coming out every day about this plan by the city/police/courts\, so our responses to protect our clients and stand against this injustice are also evolving. We will continue to monitor the developments\, share information and provide support as this unfolds. Thanks for being in this fight together! \n  \n

SUMMARY:MCLE Presents: Pozner on Cross
DESCRIPTION:This program is hosted by MCLE. Any questions or issues regarding this program should be directed there. (customerservice@mcle.org). This event is being listed for informational purposes only. CPCS staff cannot assist with\, or solve\, registration issues.\nPOZNER ON CROSS: OCTOBER 29\, 2021 (9:30 to 4:30) CLE:  6 MH CREDITS \n\n\n\nPOZNER ON CROSS \nIt’s not your strong opening argument. It’s not your skillful direct. It’s not how many of your impassioned objections the judge sustains. It’s not your confident demeanor. It’s not even how you tie your theory of the case together with a dazzling closing statement bow. \nWhat wins your trial is your cross. \nCross-examination is the single most important element of a trial well-conducted. When you learn to do it right\, Larry Pozner says\, you accomplish four critical goals: (1) you amp up the witness’s voice to relate each fact of your story to the jury; (2) you break that story down into clear\, veridical “chapters”—factual building blocks that trigger and channel jury cognitions; (3) you construct logical\, semantic links between your opening and closing—links necessary for the jury to resonate with your theory of the case; and (4) you use witness emotion—like anxiety—to reconstruct fading memories\, compel honesty\, eliminate distortions\, close down paths to irrational outcomes\, and empower your jury to reach a clear decision. \nPozner shares signature techniques well-grounded in current thinking about the neuroscience of decision\, memory\, and emotion. He trains you on three tactical rules of cross-examination that have made his bestselling book\, Cross-Examination: Science and Techniques (3rd Ed.\, LexisNexis)\, a wildly popular guide for courtroom lawyers. He explains how leading questions can moderate witness behavior on the stand; how simple sentence construction\, fact-ordering\, and the paintbrush of mental imagery can make a witness malleable; and how simple\, logic-based facts can build memorable narrative\, channel judge and jury cognition\, and drive the engine of inference to your advantage. \nPozner calls his technique “The Chapter Method of Cross-Examination.” Learn it just once\, and you can use it with spectacular results for the rest of your career. This entertaining\, hands-on training offers you sample “chapters” and powerful sample scripts that you can tailor to your own facts. Let Pozner teach you how to derail your opponent and impeach the key witness—even the most evasive\, memory-challenged or talkative one—in just a matter of minutes.\n\n\n\n\n\n\nInstructor\n\n\n\nLarry Pozner is a nationally recognized trial lawyer\, lecturer\, and author out of Denver\, CO. Larry’s lectures are built around the newest tools for understanding how to motivate jurors to award us the verdict we seek\, the advanced techniques of cross that can immediately result in an advantage in trial\, and how we can all become quicker at crafting the cross examinations that win cases. Larry began his career in the Colorado Public Defender system. He later formed a criminal defense firm\, and a subsequent firm handling both plaintiff and defense sides of document-intensive civil matters for businesses large and small\, but if we are being blunt\, mostly large. For many years Larry defended the Denver Broncos franchise in trials including the lawsuit challenging Pat Bowlen’s purchase of the team. Larry won\, which is why he could remain in Colorado. Larry is a past-President of the National Association of Criminal Defense Lawyers. He is listed in Best Lawyers in America for Bet-the-Company litigation\, and in Criminal Defense\, both White Collar and Non-White Collar crimes. He has lectured in 48 states\, throughout Canada\, and strangely\, Brazil. As a teacher at the University of Denver College of Law he was voted Best Professor. But that may have been due to his “nobody flunks” policy.\n\n\n\n\n\n\n\nMaterials\n\n\n\nThe materials for this program are available online only and can be downloaded via the link emailed to you upon registration.\n\n\nAlso\, there is no need to take extensive notes.
