DECISION AND THE MEDICAL RECORDS EXCEPTION TO THE HEARSAY RULE \nHOUR ONE \nAttorneys Joan LeGraw and Mike O’Brien will give a presentation on the P.R. decision\, its history\, and the impact on permissible expert testimony. The second part of the presentation will review the medical records exception to the rule against hearsay .  We will review the Bouchie decision and its progeny and discuss how the caselaw provides a roadmap for counsel to analyze the admissibility of medical records.  Following the presentation there will be an opportunity for audience questions or comments. The program will begin with a brief history of the current law that all substituted judgment orders must be reviewed at least annually. The applicable provisions of the Massachusetts Uniform Probate Code will be reviewed. Topics will include the steps assigned counsel should take regarding lapsed orders\, changed circumstances that may affect the client’s capacity\, insufficient completion of required documents\, and the potential need for an independent medical examiner. In small breakout groups\, participants will discuss several hypothetical fact patterns\, including client decisional ambivalence and/or resistance to advice\, the role of standby counsel\, and the failure of Petitioner to file appropriate pleadings in DNR and Rogers cases. DESCRIPTION:“Writing to Persuade”\n Presenter: Prof. Timothy Terrell \nEmory Univ. School of Law \nMay 9 & 13\, 2022 \n1pm to 4pm both days – On Zoom \n Persuasive writing is not a product of gimmicks or isolated tips.  It is instead based on a deeper understanding of the elements of rhetoric and their relation to the fundamental principles of excellent writing.  This perspective emphasizes the methods of communicating with a skeptical\, risk-averse reader:  strong introductions\, compelling presentations of law and facts\, and the flow of one’s prose.  This program therefore begins at the “macro” level of a brief’s organization and moves later to the “micro” levels of paragraph and sentence structure.  Examples are developed in detail throughout. \nThis program will be valuable for attorneys who practice in the trial courts and the appellate courts\, alike. While Professor Terrell will use terms like “brief” and likely examples from appellate filings\, the content of the program will be applicable and useful to any attorney who wishes to sharpen their persuasive writing skills. \nTimothy P. Terrell is a Professor of Law at Emory Law School. He has three distinct areas of teaching and scholarly reputation: legal writing\, legal ethics\, and legal theory. He has published extensively on all these topics\, and frequently conducts continuing legal education programs on them as well. Concerning legal writing in particular\, he is\, among law faculty nationwide\, the leading presenter of programs for practicing lawyers and judges\, not just in the United States\, but around the world. On April 7th\, presenter\, Dr. Itiel Dror\, will present research and evidence from real casework reflecting the psychological mechanisms by which forensic and other experts make biased and erroneous decisions and how exposing such weaknesses of the experts can be used in our cases for our clients’ benefit. Therefore\, experts are heavily relied upon as their judgment and decision making is regarded as objective and impartial. Drawing from the field of criminal justice\, I will present research and evidence from real casework that many different types of biases affect even experts\, including fingerprinting and DNA forensic laboratory decision making. Legal and forensic evaluations are highly impacted (and can be distorted) by irrelevant contextual information or even by the context in which information is presented or obtained. Confirmation bias and other cognitive biases that I will discuss are implicit and impact hard working\, dedicated and competent experts\, and thus are widespread but hard to detect. I will articulate the psychological mechanisms by which forensic and other experts make biased and erroneous decisions.
