SUMMARY:Implications of the Absence of Chevron Deference Across Practice Areas
DESCRIPTION:Implications of the Absence of Chevron Deference Across Practice Areas\n\n\nImpact of the Supreme Court’s decision in Loper Bright Enterprises v. Raimondo on judicial review of state and federal agency actions and on agency decision-making\n\n\n\nIn June 2024\, the United States Supreme Court announced that actions of administrative agencies were no longer entitled to judicial deference under the doctrine announced in Chevron USA\, Inc. v. National Resources Defense Council\, Inc. and used by lower federal courts since 1984. The Chevron doctrine sometimes required courts to defer to “permissible” or “reasonable” agency interpretations of statutes even if a reviewing court would have interpreted the statute differently in the first instance. This program brings together lawyers advising state agencies and private clients on the extent to which the Loper Bright court’s determination that courts have primary responsibility for interpreting statutes will change how state and federal agencies approach decision-making and how reviewing courts will regard agency actions.\n\n\n \n\n\nAgenda\n\n\n\n\nExperience with Judicial Review Under the Chevron Doctrine\nHow Loper Bright Will Change How Federal Courts’ Review of Agency Actions Involving Interpretations of Statutes\nJudicial Review of State Agency Actions in Massachusetts and Why Loper Bright Is Unlikely to Have an Impact\nPotential Impact of Loper Bright Weakening of Deference on Several Practice Areas\n\n\n\n\n \n\n\nFaculty\n\n\n\n  \n\n\n\n \n\n\n\n  \n\n\n\n\nProf. Renée M.
