SUMMARY:MCLE – Toxicology for Lawyers: Drug & Alcohol Testing
DESCRIPTION:MCLE – Toxicology for Lawyers: Drug & Alcohol Testing\n4/25/2023 \n2-5pm \nThis program is hosted by the organizer listed below. Any questions or issues regarding this program should be directed there. This event is being listed for informational purposes only. CPCS staff cannot assist with\, or solve\, registration issues. \nToxicology for Lawyers: Drug & Alcohol Testing: Understanding the Principles and Interpreting the Results of Toxicological Testing in your Cases. \nUnderstanding drug and alcohol testing is an important aspect of legal practice. Learning how to interpret results (and knowing when to consult with an expert) from these methods and analyses is vital to the success of many cases\, whether cases in adult criminal or juvenile court\, child custody or other care and protection cases\, violation of probation hearings\, or other legal matters involving drug or alcohol evidence. Allegations of drugs or alcohol use and mis-use are not always supported by the weight of relevant scientific evidence. Weighing that evidence involves a detailed understanding of testing methods – both “screening level” and “confirmatory” tests – their strengths and weaknesses\, and why they can provide ambiguous results. This is especially true of tests involving opiates and amphetamines. Testing for ethyl alcohol – whether in people’s breath\, urine\, or blood – can yield more straightforward results\, but the proper extrapolation of those results involves a detailed understanding of the pharmacokinetics of ethanol and the testing methods’ shortcomings. Understanding and interpreting the results will generally require detailed laboratory reports and medical records – even such an apparently simple process as weighing suspected drug samples may not be as straightforward as it appears. \n  \nJoin our experts as we look at the fields of analytical chemistry\, toxicology\, pharmacokinetics\, and statistics\, and their roles in both criminal and care & protection cases. Learn how to evaluate the evidence\, know when to obtain and use your own experts\, and practical litigation tips. \n  \nhttps://www.mcle.org/

SUMMARY:White Collar Criminal Cases at The State Court Level
DESCRIPTION:The proliferation of smartphone and mobile computing technology has resulted in society’s dependence on the creation and exchange of electronically stored information.  People store a substantial amount of private information on their mobile devices.  Plastic credit cards are being replaced by their digital counterparts using “near field communication” technology at the cash register. Motor vehicles contain their own internal computers with “infotainment” data.  Security systems connect with users across the cloud. Daily life occurs on the “ground\,” but many routine transactions and interactions occur in the “cloud.”  As a result\, the definition of the “white collar” criminal case has evolved making it more routine at the state court level.  The procedural and evidentiary issues these cases present can be streamlined and organized once identified.\nThe following are some of the topics this program will cover accompanied by a “View from the Bench”: \n\nIdentifying automatic discovery under Mass. R. Crim. P. 14\nDrafting and litigating the pretrial production of third-party records under Mass. R. Crim. P. 17\nDocument management and review tools\nCell Site Location Information (“CSLI”)\, social media evidence\, motor vehicle data\, and the Internet of Things (“IoT”)\nExpert witnesses and forensics\nTrial preparation and presentation\n\nFaculty:\nHon. Matthew Machera\, First Justice\, Chelsea District Court\nADA Greg Connor\, Norfolk County DA’s Office\nDaniel Gelb\, Esq.\, Gelb & Gelb LLP \nOnline Only\nCPCS has approved this program for 2.0 CLE credits.
