Philipson\, Esq. – Deputy Legal Counsel\, Massachusetts Superior Court\nBrian J. Harkins\, Esq. – Senior Reference Attorney\, Social Law Library \nOnline Only \nLegislative history is a critically important advocacy tool in Federal Court when statutory language is ambiguous and begs for clarification. Federal judges invite and apply the use of legislative history to avoid incongruous results\, illuminate drafting errors\, determine specialized meanings\, or choose reasonable interpretations of politically controversial statutes.\nIn these and other instances\, Congress’s intent must be inferred from the statute’s legislative history\, which successful advocate’s must stitch together from a variety of sources including:\n– The text of the bill and proposed amendments that were accepted or rejected\n– Transcripts of hearings conducted by Congressional committees responsible for the bill\n– Committee reports written about the bill\n– Transcripts of House and Senate floor debates related to the bill \nAlex Philipson\, who has taught classes in appellate writing at New England Law Boston and Northeastern University Law School\, and Senior Reference Attorney Brian Harkins will show the “how” and “where” to find and interpret these and other sources of legislative history. \nThis program teaches advocates the research skills necessary to reconstruct a statute’s legislative history for use in pleadings\, briefs and oral arguments. \n2 CLE: CAFL\, Adult Criminal\, MHLD\, YAD

SUMMARY:CAFL Trial Panel Training (September 9 – October 20\, 2021)
DESCRIPTION:CAFL Trial Panel Training (September 9 – October 20\, 2021)\nCPCS is now accepting applications for its Fall 2021 CAFL Trial Panel Certification Training to represent children and parents in care and protection/termination of parental rights cases.  The on line training includes a mix of substantial self-directed learning and live Zoom sessions two mornings a week for four weeks.  The training concludes with a full day mock hearing. Preference will be given to attorneys who submit applications by August 9 and who commit to accepting cases in central and western Massachusetts\, where we currently have an attorney shortage. The agency actively seeks to diversify its private attorney panel membership. \nThe training will be a mix of live on-line sessions and substantial self-directed learning.  The training will begin with an orientation via Zoom on Thursday\, September 9 from 2:00 – 4:00 PM. The live sessions will be held from 9:00 AM – 12:30 PM on the following dates:  September 14\, 17\, 20\, 23\, 27\, 30\, and October 4 and 7.  Attorneys accepted into the training will also complete a mock hearing over two mornings on either October 14-15 or October 19-20.  \nFor more information about the training and to download the application\, click [here].
