COMPENSATION RATES (link to Chap. 5 sec. 33 of the CPCS Assigned Counsel Manual)
DEFINITION OF IN-COURT TIME:
Time actually engaged in evidentiary hearing or trial; e.g., pre-trial hearing, court conference with judge, jury empanelment, trial, plea hearing, dispositional hearing, post-trial hearing.
DEFINITION OF OUT-OF-COURT TIME:
Time actually spent in preparation; e.g., client or witness interview, investigation, research, and negotiation or travel (consistent with Committee travel policy), waiting, default, continuance, withdrawal.
WAITING TIME (includes DEFAULTS, WITHDRAWALS, and CONTINUANCES):
Attorneys may bill for ACTUAL TIME spent waiting in court for UP TO ONE (1) HOUR per client for each court appearance in the cases. Compensable waiting time may not exceed three hours per day. Waiting time is billed at the out-of court rate.
