Is a Nursing Home Really Necessary?

Representing Elderly Respondents in Guardianship Proceedings:
issue-spotting and referral sources to broaden your client’s options for independence

Your responsibility under Article V of the Mass. Uniform Probate Code (G.L. c. 190B), of course, is to advocate for your respondent-client’s legal interests in the guardianship proceeding.  But there may be collateral issues which may determine your client's ability to maintain his or her independence.  Does this scenario sound familiar?: Your client is admitted to a hospital for an acute medical problem.  Subsequently, the hospital petitions for guardianship in order to discharge the client to a nursing home.  Time is of the essence at this point.  You must explore and preserve the client’s options so as to maintain his or her housing or find another community-based alternative, and to maintain his or her benefits.  Elder law specialists will provide information and resources to help you spot these issues and make appropriate referrals.
